Terms of Service

By creating an account or using Sarvak (the "Service"), you agree to these Terms. If you disagree, do not use the Service. The Service is operated by Sarvak.

• You must be at least 18 years old.
• Access is granted only after manual review — access is not guaranteed upon registration.

You agree to use the Service only for lawful purposes. You must not:

• Send emails to contacts who have not explicitly opted in to receive communications from your organisation.
• Upload purchased, harvested, scraped, rented, or otherwise unverified contact lists.
• Send emails that contain illegal content, malware, phishing, or deceptive material.
• Impersonate another person or organisation in your sender identity.
• Use the Service to send to contacts who have previously unsubscribed.
• Attempt to bypass rate limits, quotas, or security controls.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.

You are solely responsible for ensuring your sends comply with all applicable laws, including:

• CAN-SPAM Act (USA) — include physical address, honour opt-outs within 10 business days.
• GDPR (EU/UK) — have a lawful basis for processing; honour data subject rights.
• DPDP Act 2023 (India) — obtain valid consent before sending emails.
• CASL (Canada) — have express or implied consent before sending commercial messages.

Sarvak automatically includes a legally required unsubscribe link in every outgoing email and maintains a permanent suppression list of opted-out contacts. You must not disable or circumvent these mechanisms.

• A monthly sending quota applies. Quota is set during account setup.
• Quota is consumed at send time. Unused quota does not roll over.
• We reserve the right to reduce or suspend your quota if your bounce rate exceeds 5% or complaint rate exceeds 0.1%.
• Sending limits exist to protect shared infrastructure and domain reputation.

• You are responsible for maintaining the security of your account credentials.
• Notify us immediately at legal@sarvak.in if you suspect unauthorised access.
• We are not liable for losses arising from unauthorised access due to your failure to secure credentials.

The Service, its design, code, and branding are owned by Sarvak. You retain ownership of your content (email templates, contact data, email copy). We process your content only to deliver the Service.

We target best-effort availability but do not guarantee any specific uptime SLA. Email delivery relies on cloud infrastructure which may have its own outages. We are not liable for delivery failures caused by upstream infrastructure.

To the maximum extent permitted by law, Sarvak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising from your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed ₹5,000.

• You may close your account at any time from account settings or by emailing us.
• We may suspend or terminate your account immediately for violation of these Terms, without notice.
• Upon termination, your data is scheduled for deletion within 30 days, except where retention is required by law.
• Suppression lists are retained indefinitely to honour unsubscribe requests.

We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
